Parking Waiver
BY PURCHASING A PARKING SPACE FROM US, YOU AGREE TO THE FOLLOWING:
I - Introduction
This Parking Waiver Agreement ("Agreement") is entered into by and between the parking customer and The Stadium Shoppe on Razorback and/or The Quarters, located at 989 S. Razorback Rd. This document serves to exempt, waive, and relieve liabilities, claims, and risks associated with using the parking facilities provided by R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback and/or Canyon View Properties [DBA The Quarters].
II - Acknowledgment of Risks
The Participant / Parking customer acknowledges that the use of parking facilities and services may involve certain risks and potential hazards, including but not limited to property damage, theft, and unforeseen accidents. The Parking Customer freely assumes these risks for allowing their vehicle to be parked within the premises managed by R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback], and/or Canyon View Properties [DBA The Quarters].
III. - Terms and Conditions
Parking in the R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback] , and/or Canyon View Properties [DBA The Quarters] parking lot is entirely voluntary. The person parking confirms understanding and acceptance of the general conditions applicable to the use of the parking facilities, including any site-specific rules and regulations as communicated by R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback] or any of its employees from time to time. The parking customer agrees to comply with all such rules and acknowledges that failure to do so may result in termination of the right to use these facilities.
The Parking Customer herein agrees to release, waive, discharge, and covenant not to sue R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback] and/or its officers, employees, and agents, and/or Canyon View Properties [DBA The Quarters] from any and all liability to The Parking Customer, his/her personal representatives, assigns, heirs, and next of kin for any loss or damages, and any claims or demands therefore on account of injury or damage to the vehicle, whether caused by the negligence of R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback] and/or Canyon View Properties [DBA The Quarters] or otherwise while the vehicle is stationed at the parking facility.
The Parking Customer further agrees to indemnify and hold harmless R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback] and/or Canyon View Properties [DBA The Quarters] from any loss, liability, damage, or costs they may incur due to the participation of The Other Parking Customers in the parking lot whether caused by the negligence of The Parking Customer or otherwise.
This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which R.E.M. Sports Unlimited LLC [DBA The Stadium Shoppe On Razorback] and/or Canyon View Properties [DBA The Quarters] operates without any regard to its conflict of law provisions. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement.
VII. Confirmation
BY PURCHASING A PARKING PASS the Parking Customer ACKNOWLEDGES THAT HE/SHE HAS READ THIS DOCUMENT AND UNDERSTANDS ITS CONTENTS, THAT HE/SHE IS AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT, AND DULY AUTHORIZES THIS RELEASE BY HIS/HER OWN FREE WILL.
